13. 14.01.2015 Heard learned counsel for the parties.

Pursuant to order dated 13.01.2015, the S.D.O., Narkatiaganj is present in Court and also files a counter affidavit. He has expressed his unconditional and unqualified apology for not responding to the request of the learned State counsel to file an affidavit in the present case. He personally assures the Court that such type of conduct shall not be repeated in future.

In view of the aforesaid, this Court does not propose to proceed against him.

Coming to the merits of the case, it has been stated in the counter affidavit filed that the heirs of the

Patna High Court CWJC No.10843 of 2011 (13) dt.14-01-2015 2/3 deceased are being paid pension and the benefit of the 6th pay revision has been granted and pay slip issued by the Accountant General, Bihar. He assures that actual payment shall also be made to the petitioner and the difference of the salary and pension arising out of such revision shall also be paid without delay.

In view of the aforesaid, the application stands disposed off with a direction that all admitted dues of the petitioner shall be paid to her without any delay. Whatever required sanction is to be granted by the S.D.O., Narkatiaganj shall be so done within 10 days from today. The Accountant General, Bihar shall issue necessary authority slip within three working days of the sanction letter having been sent by the S.D.O., Narkatiaganj. Thereafter, the S.D.O., Narkatiaganj shall ensure actual payment within the next 10 days. Learned counsel for the petitioner has submitted that there is some discrepancy in the computation of the G.P.F. In view of the aforesaid, the petitioner is given liberty to file a detailed representation before the S.D.O., Narkatiaganj as well as the Assistant Director, G.P.F.

Directorate, Patna who shall look into the grievance of the petitioner as raised in her representation and decide the same within three weeks from the date of filing of such representation.
