The petitioner is in custody in connection with Sadar Hajipur P.S. Case No. 12 of 2019 for the offence under Sections 414/34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2018 and Section 25 (1-B) (A)/26/35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Learned counsel for the petitioner submits that in the instant 1368.640 liters liquor was seized from the house of co-accused Naresh Sharma not from the possession of this petitioner.
