2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code.
3. As per F.I.R., on 15.08.2023 at 6 PM, all the accused persons surrounded informant and tied his hands & legs and thereafter, it is alleged that this petitioner and co-accused Sandeep Kumar assaulted informant by means of iron rod and lathi, whereas co-accused Kaushal Rai snatched gold chain, cash of Rs. 2000/- and mobile phone from the informant.
4. Learned counsel for the petitioner submits that F.I.R. has been lodged after a delay of 25 days and there is no plausible explanation of delay. Allegation of assault is general
Patna High Court CR. MISC. No.25759 of 2025(2) dt.13-05-2025 2/2 and omnibus. Co-accused Sandeep Kumar, having similar and identical allegation, has already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 05.12.2023 passed in Cr.Misc. No. 76344 of 2023. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Pupri, Sitamarhi / concerned court in connection with Bajpatti P.S. Case No.275 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
