JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Khutauna P. S. Case No. 11 of 2017 registered under Sections 147, 148, 149, 341, 323, 342, 324, 325, 307, 332, 353, 388, 504 and 506 of the Indian Penal Code.

Regard being had to the allegation that the petitioners assaulted the police personnel and when other police personnel went to rescue them, they were also assaulted and from perusal

Patna High Court Cr.Misc. No.21488 of 2017 (3) dt.07-07-2017 2/2 of the case-diary, it would appear that several police personnel sustained injuries, I am not inclined to grant pre-arrest bail to the petitoners. Accordingly, their prayer for grant of pre-arrest bail is rejected.

However, in case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order. (Ashwani Kumar Singh, J.) Kanchan/- U T
