====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-11-2020 Heard learned Counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending arrest in connection with Bakhtiyarpur P.S. Case No. 457 of 2017 registered for the offence under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26,35 of the Arms Act.

It is alleged that during the patrolling duty when the police party reached Bakhtiyarpur Block they received secret information that Nitish Kumar Yadav and others were preparing for committing dacoity and when the police reached near Chhatra Pal Baba Temple they apprehended three persons and rest fled away. The name of this petitioner was disclosed

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has been falsely been implicated in this case. The petitioner has no criminal antecedent. Nothing incriminating has been recovered from the petitioner to connect the petitioner with the crime. Considering the fact that the petitioner has no criminal antecedent and nothing was recovered which can connect the petitioner for commission of any crime, the Court is inclined to grant privilege of anticipatory bail to these petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1st Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 457 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P.C. (Anil Kumar Upadhyay, J) spandey/- U T
