Since there is no order, which is under challenge, nor any demand has been raised upon the respondent authorities for grant of matric-trained-scale, there is no failure on the part of the respondents to perform any public duty.
In view of the same, this Court will not pass any order at this juncture.
Let the petitioner assert his right by moving the competent authority. He is free to point out to the said authority, the law, which has been rendered in the case of Chandra Kant & ors. Versus The State of Bihar & ors., reported in 2010 P.L.J.R. (IV) 732, especially paragraph 36 of the said decision.
Patna High Court CWJC No.7790 of 2014 (2) dt.09-05-2016 2/2 Writ application is disposed off with observation and direction as above.
