JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 272, 273 and 290 of the Indian Penal Code and section 47(A) of the Excise Act. It is alleged that 96 bottles each containing 200 ml of country liquor was recovered from a Gumati.
The petitioner submits that the Gumati from where 96 bottles of country liquor was recovered does not belong to him. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, the petitioner Jairam Kumar is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Mali P.S.
