JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 353, 504 of the Indian Penal Code.
Prosecution case in brief is that as per FIR, on 14.01.2020 at 12 pm the petitioner came in branch office of Bank of India and he did query to the informant about his a/c no. 577410110010164 why freezed the said account due to illegal transaction after receiving e-mail from Surat Main Branch due to suspicion transaction in this account. After that the petitioner made pressure to regularize the said account and
Patna High Court CR. MISC. No.23658 of 2020(4) dt.09-11-2020 2/2 also misbehaved with the informant. The informant lodged FIR against the petitioner.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to some ulterior motives. The petitioner is in jail custody since 15.01.2020 and has got clean antecedent. Learned APP for the State opposes the prayer for bail petition.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Shikarpur P.S. Case No. 22 of 2020.
