The learned counsel for the plaintiff-respondent is present and has submitted that the T.S.No.945/2013 has already been disposed of and therefore the present application filed under Article 227 of the Constitution of India challenging the order by which the prayer of the petitioner for impleadment as party under Order 1 Rule 10 C.P.C. in the suit has been rejected, has become infructuous.
In view of the aforesaid submission on behalf of the plaintiff-respondent, this application is dismissed as infructuous.
