JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Laheriasarai P.S. Case No. 456 of 2019 for the offence under Sections 307 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that from the first information report it would appear that there is no allegation of any overt act against the petitioner and he is in custody since 16.04.2020.
Considering the fact that there is no allegation of any overt act against the petitioner, the Court is inclined to grant bail
Patna High Court CR. MISC. No.22549 of 2020(4) dt.04-01-2021 2/2 to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S.
