JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Barauni Rail P.S. Case No. 50 of 2019 registered for the offence punishable under Sections 414 and 34 of the Indian Penal Code and Sections 137, 145 and 147 of the Indian Railway Act read with Sections 20 and 22 of the N.D.P.S. Act.

The petitioner had earlier approached this Court for grant of regular bail, which was rejected by an order dated 11.12.2019 passed in Cr. Misc. No. 48567 of 2019 with an observation that the petitioner shall be at liberty to apply for regular bail after six months, if in the meanwhile, the trial was not concluded.

Patna High Court CR. MISC. No.24407 of 2020(2) dt.22-01-2021 2/2 Mr. Pratish Kumar Lal, learned counsel appearing on behalf of the petitioner has argued that there is no substantial progress at the trial before the Court below. On perusal of the paragraph 3 of the application, it appears that the petitioner has long criminal history of his involvement in 14 different cases, mainly disclosing offences punishable under Sections 379, 380 and 414 of the Indian Penal Code.

However, considering the circumstance that the petitioner is in custody since 26.04.2019, in the light of this Court's observation in the order dated 11.12.2019 passed in Cr. Misc. No. 48567 of 2019, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, N.D.P.S. Act, Begusarai in Barauni Rail P.S. Case No. 50 of 2019.
