The petitioner apprehends his arrest in Shastri Nagar P.S. Case No. 261/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The daughter of the deceased stated that her father was a rag picker and he used to sell rags to the shop of the petitioner. The father of the informant used to reside in the shop of the petitioner. She further disclosed that her father was taking wine. The informant came to know that the petitioner and others assaulted her father with bottle and bricks and the dead body of her father was found outside the boundary of the shop of the petitioner.

The petitioner went to inform the informant about the death of her father. If the petitioner killed the father of the informant, he would not inform about the death of the father of the informant. The informant and her brothers have made same and similar allegation raising suspicion against the petitioner. Except the suspicion, the investigating officer has not collected any material to show the involvement of the petitioner.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Indrani Kishku, Judicial Magistrate 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 261/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
