JUSTICE RAVI RANJAN ORAL ORDER 30-08-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 322, 324, 307, 379, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is contended that there is admitted land dispute between the parties with respect to erecting some pillar on the land due to which altercation allegedly took place and there is case and counter case. The petitioner no.1 had also sustained injury. It is urged that the main allegation of firing, due to which the informant received firearm injuries, is upon co-accused Vinay Rai. So far as petitioners are concerned, the allegation is general and omnibus in nature. It is also stated that the petitioners are having

Having regard to the facts and circumstances of the case, let the petitioners above-named be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Tajpur (Halai O.P.) P.S. Case No.140 of 2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Samastipur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
