The petitioner, who is the elder brother of the husband of the deceased seeks bail in connection with Belhar P.S. Case No. 141 of 2016 dated 20.04.2016 instituted for offence Sections 304B/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that except for the relationship between the husband of the deceased and him, there is no other material to connect the petitioner with the offence. The allegation against the petitioner is of general and omnibus nature and the deceased

Patna High Court CR. MISC. No.26988 of 2020(2) dt.19-10-2020 2/2 along with her husband stayed separately from the petitioner and others. Two of the other brothers of the husband of the deceased have been granted bail by a Bench of this Court, which order has been annexed with the bail petition. The petitioner is in custody since 28.01.2020 and the husband of the deceased also is in custody. Considering all these facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Belhar P.S. Case No. 141 of 2016.
