This application, for grant of anticipatory bail, arises out of Turkauliya P.S. Case No. 106 of 2017 disclosing offences under Sections 147, 148, 149, 307, 326(A), 341, 323, 324, 379, 380, 435, 504 and 506 of the Indian Penal Code. Case diary is available. The doctor has reported that the injury was caused by chemical burn which is grievous in nature.
Learned counsel for the petitioner has submitted that the injury report has been prepared by the doctor in very casual manner and that all other co-accused persons have been granted
Patna High Court Cr.Misc. No.43907 of 2017 (4) dt.19-12-2017 2/2 anticipatory bail. In spite of the aforesaid submission, I am not inclined to allow the privilege of anticipatory bail to the petitioner since the allegation of throwing acid is direct against the petitioner and not against the other persons, who have allowed anticipatory bail.
This application for anticipatory bail, is hereby, rejected.
The petitioner, Deepak Rai @ Deepak Kumar Yadav is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
