2. The petitioners apprehend arrest in Khagaria (Muffasil) P.S. Case No. 1199 of 2023, registered under Sections 302 and 34 of the Indian Penal Code.

3. The allegation against the petitioners along with others is of killing the husband of the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Learned counsel for the petitioners also submits that the allegation levelled against the petitioners are general and omnibus in nature, rather specific allegation of assault is

Patna High Court CR. MISC. No.30576 of 2024(3) dt.12-07-2024 2/2 against Ramvali Sharma and Naresh Sharma. It is alleged that the petitioners were only the members of the mob. The petitioners have got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated co-accused have been granted regular bail by this Court vide order dated 25.04.2024 passed in Cr. Misc. No. 31854 of 2024 and order dated 24.06.2024 passed in Cr. Misc. No. 42037 of 2024.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances, let the petitioners, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Khagaria (Muffasil) P.S. Case No. 1199 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Rudra Prakash Mishra, J) Rajorshi/- U T
