The petitioners apprehend their arrest in Paroo P.S. case No. 162 of 2015 under Section 304B/34 of the Indian Penal Code and under Section 3⁄4 of the Dowry Prohibition Act. The petitioners are brother-in-law, mother-in-law and father-in-law of the deceased. The informant alleged that his daughter was married with Md. Rafique, son of petitioner No.3, on 10.05.2012. The husband and others were demanding dowry. The informant got information that on 29.06.2015 his daughter was burnt to death.

The learned counsel for the petitioners submits that petitioners are brother-in-law, mother-in-law and father-in-law of the deceased. They were living separately. During the course of

Patna High Court Cr.Misc. No.16333 of 2017 (3) dt.07-07-2017 2/2 investigation, the villagers disclosed that the deceased accidentally caught fire while she was cooking food.

It appears that the informant did not make any specific allegation against the petitioners and the petitioners submit that they are brother-in-law, mother-in-law and father-inlaw of the deceased. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, West, Muzaffarpur in Paroo P.S. Case No. 162 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
