2. The petitioner has preferred this application for grant of regular bail in connection with Panapur P.S. Case No. 06 of 2014 dated 02.02.2014 registered for the offences punishable u/ss 147, 148, 149, 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act and Section 17 of the C.L.A. Act.
3. As per the prosecution case, the petitioner and several other accused persons are named in the F.I.R. on the accusation that they committed murder of the informant's son. It is further alleged that the petitioner is the member of the extremist organization.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.28292 of 2024(2) dt.27-06-2024 2/3 this case. There is general and omnibus allegation against the petitioner. The petitioner is made accused in this case only because of his name is Jamadar Raut and at Sl. No. 18 of the accused column of F.I.R., the name of Jamadar Jee of villageBhagwanpur is mentioned but the petitioner is resident of village- Brit Bhagwanpur, which is another village and no other details is mentioned in the F.I.R. There is no specific allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner is not the member of any extremist organization. The co-accused person has already been granted regular bail by the Coordinate Bench of this court vide order dated 29.09.2016 passed in Cr. Misc. No. 40425 of 2016. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.01.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.28292 of 2024(2) dt.27-06-2024 3/3 concerned, Saran at Chapra in connection with Panapur P.S. Case No. 06 of 2014 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
