ANJANA PRAKASH ORAL JUDGMENT Date: 20-03-2015 Heard learned counsel for the Petitioners and the State. The Petitioners seek quashing of the order of cognizance dated 7.8.2010 passed in Ballia P.S. Case No. 87 of 2010 by the Chief Judicial Magistrate, Begusarai.
The case of the Informant is that while he was returning, the accused persons told him to forego his possession of land, even though, they had executed a conditional sale deed in his favour. Thereafter, they assaulted him and snatched his wrist watch. It has been submitted on behalf of the Petitioner that dispute centres around the land which they had given to the Informant
Patna High Court Cr.Misc. No.26832 of 2011 dt.20-03-2015 2/2 on Sulahnama and on account of the dispute earlier, a Complaint had been instituted vide Complaint Case No.550c of 2010 by the Petitioner No. 1. Now Parties agree that they do not want to pursue the present Prosecutions.
In view of such understanding, the application stands allowed and the order of cognizance dated 7.8.2010 passed in Ballia P.S. Case No. 87 of 2010 by the Chief Judicial Magistrate, Begusarai as also the Complaint Case No. 550 c of 2010 are hereby set aside. The application stands disposed off with the aforesaid observation.
