Petitioner apprehends his arrest in a case filed under Sections 323. 448, 307, 452, 504, 506/34 of the Indian Penal Code and Section 25(1-b)A, 26, 35(ii) of the Arms Act. It is contended that the petitioner was not apprehended from the spot and in view of the dispute with regard to the wages the petitioner has been named in the first information report. In fact there is no assault upon the informant or others by the petitioner, therefore, the allegation made under the aforesaid provision of law under which the case has been registered are not made out so far as the petitioner is concerned. Petitioner claims that his antecedent is clean.

Case No.34/2016, the above named petitioner, Kundan Kumar Thakur shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of SubJudge, 3rd cum A.C.J.M., Muzaffarpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
