The petitioners are apprehending their arrest in connection with Nabinagar P.S.Case No.83 of 2016, registered for offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code.
Allegation as per F.I.R. is that on the basis of the inquiry, the F.I.R. has been lodged against the petitioners and other accused persons for the irregularities committed by the Chairman of the Nagar Panchayat, Nabinagar on the complaint of the police. It further appears that later on the petitioners have also been made accused in this case.

No.36474 of 2017 (2) dt.10-08-2017 2/3 Submission of the learned counsel for the petitioner is that the inquiry was held and thereafter, they have also been made accused in this case and all the other accused persons who have been made accused in the inquiry report, have already been granted bail by this Court, vide order dated 13.4.2017 passed in Cr. Misc. No.16734 of 2017, dated 7.2.2017 passed in Cr. Misc. No.36343 of 2016, dated 28.10.2016 passed in Cr. Misc. No.39966 of 2016, dated 11.01.2017 passed in Cr. Misc. No.48948 of 2016, dated 20.4.2017 passed in Cr. Misc. No.9018 of 2017. The petitioners are ready to abide by any condition imposed upon them.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., Aurangabad in connection with Nabinagar P.S.Case No.83 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
With following conditions :
(i) One of the bailors of the petitioners shall be

(iii) The petitioners shall co-operate in the investigation of the case and make themselves available as and when required by the police, otherwise, the prosecution is free to move for cancellation of their bail bond.
With the aforesaid observation, this application is allowed.
