In this case, the petitioners are apprehending their arrest in connection with Sultanganj P.S. Case No. 18 of 2019 registered for offences under sections 147, 149, 323, 341, 353, 225 & 504 of the Indian Penal Code and Section 25 (1-b)a/26 of the Arms Act.

As per allegation, the police had gone to Narayanpur village and when they reached near the house of one Naresh Prasad Singh, looking to the policy party, three persons fled away from there but, one of the person was arrested

Patna High Court CR. MISC. No.24206 of 2019(2) dt.16-04-2019 2/3 who disclosed his name as Ajay Kumar Swantantra and, from his possession, the country made pistol with magazine and fourteen pieces of 315 bore cartridges were recovered. When the police moved further, 15 persons surrounded them and got released Ajay Kumar Swantantra from the police. The petitioners have been identified as being members of the mob engaged in creating hooliganism for release of Ajay Kumar Swantantra.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bhagalpur in connection with Sultanganj P.S. Case No. 18 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of
