2. The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 337, 302 of the Indian Penal Code registered in connection with Bibhutipur P.S. Case No. 179 of 2007.

3. It is submitted that the petitioner has been falsely implicated in the backdrop of petty dispute which arise between the residents of neighbouring villagers. The complaint has been filed after a delay of eight days for the alleged occurrence. The main accusation against the petitioner along with co-accused Pramod Mahto is of holding down the deceased persons Rajeev and Suresh respectively. The petitioner claims clean antecedents.

Having regard to the nature of accusations, gravity of the offence alleged and the specific accusation against the petitioner that he held down the deceased Rajeev as co-accused Vijay Jha and Rajeev Kumar pressed his neck leading to his death, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner.
