Petitioner is apprehending arrest in connection with Obra P.S. Case No. 300 of 2019 for the offence under sections 341, 323, 447, 448, 504, 427, 34 of the Indian Penal Code and Section 27 of Arms Act.

Mrs. Leewati Kumari, learned counsel for the petitioner submits allegation against this petitioner is that he alongwith others enjoyed food in the hotel and on demanding money for the hospitality he declined to pay the bill and also the accused fired two rounds at some distance to terrorise the people of the hotel.

Considering the fact that there is allegation of consuming food against the petitioner and refusing payment,

No.22529 of 2020(2) dt.04-09-2020 2/2 the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Obra P.S. Case No. 300 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 10,000/- cash to the court below and on deposit Rs. 10,000/- the court below shall release the petitioner.
