1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Simri Bakhtiyarpur (BKP) P.S. Case no. 583 of 2023 registered under sections 25(1B)(a), 26 and 35 of the Indian Penal Code.

3. As per the prosecution case, the informant states that on being signalled to stop the accused made an attempt to escape. The petitioner was caught at the place of occurrence and from his possession a loaded country made pistol was recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from

Patna High Court CR. MISC. No.27489 of 2024(3) dt.28-06-2024 2/2 his possession. He is in custody since 12.10.2023 and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R together with the petitioner having remained in custody for more than 8 months since 12.10.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Simri Bakhtiyarpur (BKP) P.S. Case no. 583 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Saharsa.
