JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 01-03-2016 The petitioner is the mother of the deceased of Vaishali P.S.Case No.329 of 2014 dated 10.11.2014 registered under sections 302 and 120B of the Indian Penal Code.

2. By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks a direction to be issued to the respondents to conduct free, fair, speedy and scientific investigation into the death of the petitioner's only son.

3. After going through the contents of the counter affidavit filed on behalf of the respondent no.5, learned counsel for the petitioner has submitted that for the present the petitioner does not

Patna High Court Cr. WJC No.1120 of 2015 dt.01-03-2016 2/2 intend to press the application as there appears to be substantial progress in the investigation of the case. However, he submits that the respondents be directed to conclude the investigation expeditiously.

4. Learned counsel for the State submits that since call details, reports etc. are to be obtained from the service provider in order to ascertain the culpability of the accused persons, some more time would be required in completing the investigation of the case.

5. Be that as it may, regard being had to the facts and circumstances of the case, the application is disposed of with a direction to the Superintendent of Police, Vaishali, Hajipur to personally look into the matter and ensure that the investigation is completed as early as possible preferably within three months from the date of receipt/production of a copy of the order.

6. Let a copy of the order be transmitted to the Superintendent of Police, Vaishali through fax. (Ashwani Kumar Singh, J) Md.S./- U T
