JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-09-2016 The prayer for anticipatory bail of petitioner no.3 Ravish Paswan has already been dismissed as withdrawn vide order dated 02.09.2016 since he was arrested by the police. Heard learned counsels for the petitioners and the State.
The petitioner nos.1 and 2 being parents of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A, 323, 341, 324 and 307/34 of the Indian Penal Code.
Prosecution case as per the fardbeyan of the informant
Patna High Court Cr.Misc. No.32590 of 2016 (5) dt.30-09-2016 2/3 Rakhi Devi, recorded at 12.30 PM in Ward No.25, Bed No.4 of Sadar Hospital, Katihar, on 28.01.2016 to the effect that the informant was married with Ramesh Kumar, but after the marriage torture was inflicted. On 28.01.2016, the petitioners including the husband of the informant assaulted the informant and after pouring kerosene oil lit fire, on alarm being raised, the neighbors came then the informant was taken to the hospital. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. Moreover, the thrust of accusation is against the husband of the informant. It is submitted by learned APP after going through the case diary that 50% burn injury has been found by the doctor, grievous in nature.
Learned counsel for the petitioners further submits that the issue between the parties has been reconciled and at present the informant is residing at her matrimonial house. Keeping in view of the aforesaid facts, let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Mufassil (Katihar) P.S. Case No.9/2016, pending before the learned CJM, Katihar.
