2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
3. As per prosecution case, the informant alleged that he was working as Sangam Manager in Bharat Finance Company Ltd., Bagaha and on the alleged date of occurrence he was going after collecting money of Rs. 1,59,267/- from different places in the meantime, some unknown miscreants came and looted the aforesaid amount from him along with mobile phone thereafter fled away.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31830 of 2024(3) dt.25-06-2024 2/2 petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was transpired in the case on the basis of confessional statement of co-accused Ranjan Chaudhary who has already been enlarged on bail by this Court vide order dated 22.6.2023 passed in Cr. Misc. No. 43657 of 2022. Neither the petitioner was put on TI Parade nor any incriminating article has been recovered from his conscious possession and he is languishing in judicial custody since 11.7.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner has got several criminal antecedents.
6. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Valmikinagar P.S. Case No. 48 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bagaha, West Champaran.
