JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506 and 34 of the Indian Penal Code and 4 of the Dowry Prohibition Act Accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the informant earlier filed Complaint Case No.404C of 2009 which got dismissed. The petitioner divorced the informant as per 'Muslim' rights on 25.12.2013 and thereafter the present FIR was registered. Though, the petitioner has filed Matrimonial Suit No.13 of 2014 on 16.01.2014 for declaring his marriage null and voice.
Patna High Court Cr.Misc. No.49616 of 2015 (2) dt.09-11-2015 2/2 Considering the nature of accusation and matrimonial suit being pending between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Birpur, Supaul in connection with Raghopur P.S. Case No.24 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
