Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Ramgarhwa P.S. Case No. 166 of 2010 for the offences registered under Sections 366A and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that after investigation, petitioner was not sent up for trial. However, after submission of final form, the Magistrate differed from the police report and took cognizance of the offence against the petitioner on 04.03.2013 and ordered for issuance of summons. However, the same was not complied with and it was only on 14.06.2016 that summons having been issued against the petitioner, thus, the petitioner is apprehending his arrest in connection with the

Having heard learned counsel for the petitioner and learned counsel for the State, it appears from the entire materials that there is nothing against the petitioner to implicate the petitioner in the present case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Raxual at Motihari, East Champaran in connection with Ramgarhwa P.S. Case No. 166 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
