The petitioners apprehend their arrest in connection with Cheria Bariarpur P.S. Case no. 13 of 2016, registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code. The allegation of informant Krishna Dvei is that her husband Krishna Nandan Singh is unsound mind and his husband is own brother of Late Shaligram Singh father of the petitioners. Taking the advantage of madness of the husband of the informant petitioners do not want to give share in the land, but for the purpose of treatment of her husband, she sold some land later on she came to know that petitioners filed Title Suit No. 58 of 2013 in the court of Sub-Judge-I,
Patna High Court Cr.Misc. No.20624 of 2017 (3) dt.20-07-2017 2/2 Begusarai against Laxmi Devi and the same suit was compromised and on the basis of compromise, the decree was passed detailing that Late Rameshwar Singh has only one son i.e. Late Saligram Singh, while her husband Krishnandan Singh is own brother of Late Saligram Singh. As such both the petitioners committed forgery in obtaining the compromise decree in that regard.
Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in this case due grudge. Further submission is that the present case is purely civil in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Manzhaul in connection with Cheria Bariarpur P.S. Case No. 13 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
