JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Khagaria (Gangour) P.S. Case No. 632 of 2017 instituted for the offence under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation in the written report against the petitioner of causing firearm injury to the informant on his right thigh.

Learned counsel for the petitioner has submitted that other co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 12.01.2018 passed in Cr. Misc. 790 of 2018.

The injury report has been enclosed as Annexure-4

Patna High Court Cr.Misc. No.7350 of 2018 (2) dt.27-02-2018 2/2 wherein the Doctor has found firearm injury on the right thigh of the informant.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
