Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Amdabad P.S. Case No.79 of 2018, registered for the offences punishable under Sections 147/148/149/341/323 /324 / 325/307/504/379/506 of the Indian Penal Code. Earlier prayer for anticipatory bail was refused on 24.09.2018 vide order at Annexure-1.

Learned counsel for the petitioner submits that the police has submitted charge sheet for bailable offences only.

Patna High Court CR. MISC. No.22350 of 2020(2) dt.24-08-2020 2/2 However, the learned Magistrate has taken cognizance on 07.05.2019 for the offence under Section 307 of the Indian Penal Code also.

Considering the facts of this case, I am not inclined to review the aforesaid order. Hence, the prayer for anticipatory bail is refused. However, it is made clear that prayer for regular bail shall be considered without being prejudiced by refusal of the prayer for anticipatory bail.
