25-07-2016 Heard Sri Krishna Prasad Singh, learned senior counsel, who was assisted by Sri Saket Kumar Singh, learned counsel for petitioners and learned Addl. Public Prosecutor. Three petitioners, apprehending their arrest in Amba P.S. Case No. 6 of 2016 registered for offence under Sections 307, 323, 341, 147, 149 of the Indian Penal Code, have prayed for grant of anticipatory bail.
At the very outset, it was submitted by learned senior counsel for petitioners that there was case and counter case in between the parties. Both the sides are close relatives and due to land dispute, occurrence had taken place. It has been argued that
Patna High Court Cr.Misc. No.27259 of 2016 (3) dt.25-07-2016 2/2 from the petitioners' side, in the said occurrence, seven persons received injuries, whereas, from the informant side, six persons have received injuries. It has further been argued that allegation has been made that the petitioners' side used lathi and rod in the occurrence. He has also relied on Annexure - 6 to the petition, which is purported compromise petition filed before the court below.
Be that as it may, keeping in view the nature of accusation as well as the fact that there was case and counter case and land dispute in between the parties, in the event of arrest or surrender within a period of six weeks from today, let all the petitioners namely (i) Md. Ajiz Ansari @ Abdul Aziz, (ii) Md. Azim Ansari @ Azimullah @ Azuimullah and (iii) Md. Hasnain Ansari be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad/concerned court in connection with Amba P.S. Case No. 6 of 2016 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
