This is an application for grant of anticipatory bail in connection with Bangaon P.S. Case No. 115 of 2017 registered for the offence punishable under Sections 304(B), 302, 201 and 34 of the Indian Penal Code.
The allegation is regarding the accused persons having conspired and killed the deceased lady for want of dowry. The learned counsel for the petitioner submits that the petitioner is the uncle of the husband of the deceased lady and has got nothing to do with the said incident inasmuch as firstly, the petitioner lives away from the house in question and secondly, no material has come in the case diary to suggest his complicity in the matter. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Saharsa in connection with Bangaon P.S.
