For the Petitioner/s : Mr. Jagjit Roshan For the Respondent/s : Mr. Vinod Shankar Modi(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-02-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State.
The petitioner is aggrieved by an order, dated 05.09.2014, passed by the learned Principal Judge, Family Court, Aurangabad, in Misc. Case No. 144 of 2013, whereby he has allowed the interim monthly maintenance allowance at the rate of Rs. 3,000/- in favour of Opposite Party No. 2, in exercise of power under Section 125 of the Code of Criminal Procedure, 1973, from the date of filing of the maintenance case, i.e. 29.11.2013.
On perusal of the order impugned and the admitted fact that the Opposite Party No. 2 is wife of the petitioner and she has no source of income, I do not find
Patna High Court CR. REV. No.890 of 2014 (5) dt.13-02-2017 2/2 any legal infirmity in the impugned order.
Learned Counsel for the petitioner has submitted, however, that the petitioner is willing to get the entire dispute resolved through alternative dispute redressal mechanism.
In the present proceeding, I need not comment anything. It is, however, observed that at any stage, if any initiative is taken in the Court of the learned Principal Judge, Family Court, Aurangabad, for amicable resolution of dispute, it is expected that the Court below shall consider it and pass appropriate orders.
This application stands disposed of with the observation, as above.
