JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-08-2020 Heard Mr. Sanjeev Kumar Singh, learned Advocate for the petitioners and Mr. Md. Aslam Ansari, learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Korha P.S. Case No. 38 of 2020 dated 21.01.2020 instituted for the offence under Sections 436 and 34 of the Indian Penal Code.

The petitioners and another are said to have set fire in the cowshed of the informant.

Learned counsel for the petitioners has stated that the petitioner no. 1 is the wife whereas the petitioner no. 2 is the mother-in-law of

the informant. Another accused person of this case has been granted anticipatory bail by a coordinate Bench of this Court. Regard being had to the nature of accusations and taking into account the gender of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of this order on their furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 38 of 2020, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
