Since petitioner does not have any legal or statutory right, which can compel the respondent-authorities to post him in a hospital of his liking, therefore, it is open to the petitioner to give up his resident-ship, if he so wants and if he does not want to serve the State at the present hospital. The State knows better, where the service of the petitioner is required to be used as a Sr. Resident.
In the counter affidavit para 4, allegation of some
Patna High Court CWJC No.16922 of 2015 (3) dt.22-11-2016 2/2 kind of favoritism has been categorically denied. A look at the same satisfies the Court that the allegation is more made than made out.
In view of the above, writ application stands dismissed.
