JUSTICE CHAKRADHARI SHARAN SINGH) 11-03-2022 The matter has been taken up for online hearing through video conference because of COVID-19 pandemic restrictions.

Order dated 24.02.2020, passed by the SubDivisional Officer-cum-Licensing Authority, Nawada, whereby the petitioner's licence to run a fair price shop under Bihar Targeted Public Distribution System (Control) Order, 2016 has been cancelled, is under challenge in the present writ application.

The petitioner has, admittedly, not invoked the

Patna High Court CWJC No.11030 of 2021(3) dt.11-03-2022 2/2 alternative remedy of appeal against the impugned order. In such view of the matter, this application is disposed of with an observation that the petitioner shall be at liberty to prefer appeal against the impugned order. It is observed that if the petitioner prefers appeal within six weeks from today with an application seeking condonation of delay in preferring appeal, the Appellate Authority shall consider the same in accordance with law, keeping in mind the fact that the petitioner was pursuing his remedy before this Court by filing the present writ application and that for a considerable period of time there were restrictions arising out of COVID-19 outbreak.
