In this case, the petitioner is apprehending his arrest in connection with Ekma P.S. Case No. 165 of 2012 corresponding to G.R. No. 5217 of 2012, S.T. No. 284 of 2015, registered for offences under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The name of the petitioner is neither in the First Information Report nor there in the charge-sheet rather his name has came during the statement made by the witness and, in pursuance thereof, exercising of power under Section 319 of the Cr.P.C., the petitioner has been summoned to appear and face trial.
Looking to the entire facts and circumstances of the
Patna High Court Cr.Misc. No.15961 of 2018(3) dt.17-04-2018 2/2 case, let the petitioner, namely, Dhun Dhun Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II, Saran, in connection with Ekma P.S. Case No. 165 of 2012 corresponding to G.R. No. 5217 of 2012, S.T. No. 284 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
