The petitioner seeks bail in a case registered under Sections 323, 341, 307, 385, 365, 427, 354/34 of the Indian Penal Code and Section-12 of POCSO Act.

The prosecution case in brief is that the accused persons demanded ransom through driver of the informant and on interrogation, they broke into door of the informant and entered her house. It is also alleged that the accused persons got fallen down her daughter on the ground and were taking her out of the house.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-11-2018.

Patna High Court CR. MISC. No. 24221 of 2019(3) dt.09-05-2019 2/2 Charge sheet has already been submitted. The statement of the victim was recorded under Section 164 Cr.P.C., in which he has categorically denied the participation of the petitioner in the alleged offence. He is the most competent witness to the entire occurrence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the fact that the victim in his statement recorded u/S 164 Cr.P.C. has not named the petitioner, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, POCSO, Patna in connection with Bakhtiyarpur P.S.
