Heard learned counsel for the parties.

This application for grant of regular bail arises out of Excise P.S. Case No. 311 of 2020, disclosing offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The petitioners' prayer for grant of regular bail was earlier rejected by this Court by order dated 14.12.2020 passed in Cr. Misc. No. 33115 of 2020 with a liberty to renew their prayer for bail, if there was no substantial progress in the trials

It is alleged in the First Information Report that 200 liters of country made wine was recovered from a Santro car, which was in occupation of the petitioners, who were apprehended at the spot.

Learned counsel for the petitioners has submitted that there is neither any progress at the trial nor there is any likelihood of conclusion of trial in near future. Considering the aforesaid submission and in the light of the liberty granted by order dated 14.12.2020 passed in Cr. Misc. No. 33115 of 2020, this application is allowed. Let the petitioners above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Gaya in Excise P. S. Case No. 311 of 2020.
