This application for anticipatory bail arises out of Budha Colony (Patna) P.S.Case N0. 78 of 2017, disclosing offences under Sections 420,379,504,506/34 of the Indian Penal Code. The informant owns a flat in an Apartment. She is said to have taken in adoption, the daughter of co-accused Ajay Kumar Barnwal. It is alleged against co-accused Ajay Kumar Barnwal that he received consideration money from co-accused Cyril Sanjay for transfer of the said flat but did not hand over the amount to the informant. When the informant tried to enter into the flat, allegedly she was thrashed by the petitioner, who is said to be working as Guard in the said Apartment. Considering the nature of allegation, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Smt.Ritu Kumari, learned Judicial Magistrate-Ist Class, Patna in Budha Colony (Patna) P.S. Case No. 78 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
