Heard learned counsel for the petitioner and learned APP.

The learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 1-3-2024 in Cr. Misc No. 7398 of 2024. It is next submitted that in Cr. Misc No. 7398 of 2024, inadvertently it was pleaded that the case was pending before the court of learned Exclusive Special Judge (POCSO Act)-cum-6th Additional Sessions Judge, Begusarai, when the case was pending before the court of learned Chief Judicial Magistrate, Begusarai. It is further submitted that by order dated 1-3-2024, six weeks' time was granted to the petitioner for surrendering,

No.29512 of 2024(2) dt.19-04-2024 2/3 but then the petitioner could not surrender as in the order dated 1-3-2024 it was recorded; "Considering the submissions made by the learned APP, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (POCSO Act)-cum-6th Additional Sessions Judge, Begusarai in connection with Muffasil Begusarai P.S. Case No.313/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C." 3.

It is thus submitted the order dated 1-3-2024 be modified to read as "Considering the submissions made by the learned APP, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of two weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Muffasil Begusarai P.S. Case No.313/2023." 4.

In view of the submission made by the learned counsel appearing on behalf of the petitioner, the order dated 1-

Patna High Court CR. MISC. No.29512 of 2024(2) dt.19-04-2024 3/3 3-2024 in Cr. Misc No. 7398 of 2024 is modified to the extent indicated above.

However, it is made clear that in the event if the petitioner surrenders on or before 3-5-2024, his bail bonds shall be accepted on the same terms and conditions. (Satyavrat Verma, J) SUMIT/- U T
