The petitioner seeks pre-arrest bail in connection with Udakishunganj P. S. Case No. 159 of 2015 registered under Sections 406, 420, 467, 468, 471, 120-B, 323 and 504 of the Indian Penal Code.
It is contended that initially, a complaint was filed which was referred to the police pursuant to which the FIR was instituted. It is further contended that the petitioner is Branch Manager of Central Bank and he has maliciously been made accused in the present case by the complainant. It is also contended that the complainant admits that he had signed on the withdrawal slip and, therefore, presumption would be it was he
Patna High Court Cr.Misc. No.21872 of 2017 (2) dt.07-07-2017 2/2 who withdrew the amount.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. Regard being had to the nature of allegation as also the fact that the petitioner being a Branch Manager of the bank has got roots in the society and is not likely to flee from justice, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in Udakishunganj P. S. Case No. 159 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
