The petitioners apprehend their arrest for the offences punishable under sections 147, 148, 149, 341, 323, 325, 333, 353, 427 and 435 of the Indian Penal Code.
The informant, S.I. of police, got information that Shambhu Chouhan and his men obstructed the road, when the police went there to remove obstruction the petitioners are alleged to have pelted stones causing injury to the police officials and also damaged vehicles of police officials.
Patna High Court Cr.Misc. No.51959 of 2015 (2) dt.22-12-2015 2/2 It is submitted that Shambhu Chouhan filed Muffasil P.S. Case No. 105 of 2015 making allegation against Md. Hazrat and others that they had come to his house and started constructing boundary over his land. The petitioners went to lodge the case but the police instead of lodging the case giving protection to the informant and lodged this false case.
Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. Sri S.K. Sharma, J.M. 1st Class, Katihar in Katihar (Mufassil) P.S. Case No. 106 of 2015, subject to the conditions as laid down in section 438 (2) of the Code of Criminal Procedure, 1973.
