The sole grievance of the petitioner is that as per revised Circular, he is entitled for gratuity amount of Rs. 10 lacs whereas only Rs. 6 lacs have been paid.
It is contended that under the old provision, the maximum gratuity to be paid was Rs. 3.50 lacs which was sanctioned and paid to the petitioner, however, after the new provision which is admittedly applicable in the case of this petitioner. Rs. 3.50 lacs has been replaced by Rs. 10 lacs whereas petitioner has been paid only Rs. 6 lacs but it is without explanation as to how such amount was

Accordingly, this writ application is being disposed of with a direction to the Director, Bihar Power Holding Company Ltd. to examine this matter and take a decision by passing a reasoned order as to how petitioner will be entitled only for Rs. 6 lacs against gratuity, though, the claim of petitioner is that he is entitled for Rs. 10 lacs as per revised provision. Let such decision be taken within a period of three months from the date of receipt/ production of a copy of this order.
