The present writ application is filed by the petitioner for direction to the respondent District Magistrate, East Champaran to transfer the duly signed Annexure-VA form to the ministry of Home affairs grant of Swantantra Family Pension to the petitioner.

Learned counsel for the petitioner submits that the husband of the petitioner was freedom-fighter and he died on 07.01.2015. Thereafter, petitioner filed application to the District Magistrate enclosing death certificate so that case of the petitioner may be forwarded to the Ministry of Home Affairs for consideration of her case for family pension under the scheme of Swantantrate Senani Samman Pension.

Patna High Court CWJC No.8138 of 2019(2) dt.17-04-2019 2/2 Learned counsel for the petitioner submits that the matter is pending at the level of District Magistrate, East Champaran and as a result of in decisiveness on the part of the District Magistrate, East Champaran the case of the petitioner has not been forwarded to the Ministry of Home Affairs for appropriate decision on the grant of Swantantra Family Pension. Considering the fact that the application for grant of Family pension is pending at the level of the District Magistrate, East Champaran, the writ petition is disposed of with direction to the District Magistrate, East Champaran to take appropriate decision in accordance with law on the issue of grant of Annexure-VA form in order to facilitate appropriate decision to be taken by the Ministry of Home Affairs in connection with grant of family pension to the petitioner. The respondent District Magistrate, East Champaran is direcdted to take decision within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the present writ petition stands disposed of.
