Petitioners apprehend their arrest in a case filed under Sections 406, 420, 467 and 468/120(B) of the Indian Penal Code.
As per the allegation, the sale deed with regard to the land in question got executed in faour of co-accused Bijay Kumar on the pretext of providing old age pension to the complainant.
So far the petitioners are concerned, allegation is
Patna High Court Cr.Misc. No.31358 of 2016 (2) dt.11-08-2016 2 / 2 that they have also actively participated. However, it is informed that vide Annexure 1, a co-ordinate Bench of this Court has already granted privilege of anticipatory bail to the main accused, Bijay Kumar.
Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Kotwai (Barai) P.S. Case No.623 of 2011, the above named petitioners, Jai Prakash Srivastava and Satya Prakash Srivastava shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
