JUSTICE BIRENDRA KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Three unknown criminals came on motorcycle and fired at the informant. The reason for the occurrence is that in the past ransom was demanded from the brother of the informant on mobile phone and on non-payment of the same, occurrence took place.

During investigation, it revealed that the petitioner had sold the said SIM to the criminals. At the time of hearing of this application, the petitioner could not produce any licence for

Patna High Court Cr.Misc. No.19881 of 2017 (4) dt.07-07-2017 2/2 sale of the SIM card nor he has any documentary proof that to which of the customer he has sold the said SIM card. Criminal conspiracy cannot be ruled out against the petitioner in the aforesaid facts and circumstances.

Hence, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Sheohar Police Station Case No. 158 of 2014 arising out of G.R. No. 525 of 2014 pending in the court of learned Chief Judicial Magistrate, Sheohar. (Birendra Kumar, J) Kundan/- U T
